These Terms of Service ("Terms") constitute a legally binding agreement between you and Creww ("we," "us," or "our") governing your access to and use of the Creww mobile application and related services (collectively, the "Services").

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

We reserve the right to modify these Terms at any time. Your continued use of the Services following the posting of revised Terms means you accept and agree to the changes.

2. ELIGIBILITY

To use our Services, you must:

Be at least 18 years of age
Have the legal capacity to enter into a binding agreement
Not be prohibited from using the Services under applicable law
Not have been previously banned or removed from our Services

By using our Services, you represent and warrant that you meet all eligibility requirements.

3. ACCOUNT REGISTRATION

To access certain features of our Services, you must create an account. When registering, you agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Keep your password secure and confidential
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized access

You may not share your account credentials or allow others to access your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. HEALTH AND FITNESS DISCLAIMER

IMPORTANT: THE SERVICES ARE NOT INTENDED TO PROVIDE MEDICAL ADVICE.

The fitness information, scores, insights, and recommendations provided through our Services are for general informational and motivational purposes only. They are not intended to be a substitute for professional medical advice, diagnosis, or treatment.

You acknowledge and agree that:

You should consult with a qualified healthcare provider before starting any fitness program or making changes to your exercise routine
You participate in physical activities at your own risk
We are not responsible for any injuries or health issues that may result from your use of the Services
The fitness data and metrics displayed may not be 100% accurate
You should never disregard professional medical advice or delay seeking it because of information from our Services

If you experience any pain, discomfort, or adverse effects during exercise, stop immediately and consult a healthcare professional.

5. FITNESS DATA AND CONNECTED DEVICES

Our Services may integrate with fitness tracking devices, wearables, and health platforms (such as Apple Health, Google Fit, Fitbit, Garmin, and others) to collect and display your fitness data.

By connecting these devices and services, you acknowledge that:

Data accuracy depends on your connected devices and may vary
We are not responsible for errors or inaccuracies in data from third-party devices
You grant us permission to access, collect, and process your health and fitness data as described in our Privacy Policy
You can disconnect devices or revoke access at any time through your device or account settings

Your fitness scores, rankings, and rewards are calculated based on the data we receive. Incomplete or inaccurate data may affect your scores and achievements.

6. USER CONTENT

Our Services may allow you to submit, post, or share content including but not limited to profile information, photos, workout data, comments, and messages ("User Content").

By submitting User Content, you:

Retain ownership of your content
Grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content in connection with the Services
Represent that you have the right to submit the content
Agree that your content does not violate any applicable laws or these Terms

We reserve the right to remove any User Content that violates these Terms or that we find objectionable, without prior notice.

Creww includes social features that allow you to connect with other users, share achievements, compete in challenges, and interact with the community.

When using social features, you agree to:

Treat other users with respect
Not harass, bully, or intimidate others
Not share inappropriate, offensive, or harmful content
Not spam or send unsolicited messages
Report any violations of these guidelines

We are not responsible for the actions or content of other users. Use caution when interacting with others and never share personal information with strangers.

8. PROHIBITED ACTIVITIES

You may not use our Services to:

Violate any applicable laws or regulations
Impersonate any person or entity
Manipulate or falsify fitness data or scores
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the Services
Reverse engineer or attempt to extract source code
Use automated systems or bots
Collect user information without consent
Engage in any activity that could harm or exploit minors
Use the Services for any illegal or unauthorized purpose

9. INTELLECTUAL PROPERTY

The Services and all content, features, and functionality (including but not limited to the design, text, graphics, logos, icons, and software) are owned by Creww and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. You may not:

Copy, modify, or distribute our content
Use our trademarks without permission
Create derivative works based on our Services

10. THIRD-PARTY SERVICES

Our Services may integrate with or contain links to third-party websites, applications, and services including fitness device platforms (Apple Health, Google Fit, Fitbit, Garmin, etc.), social media platforms, and payment processors.

We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is subject to their respective terms and privacy policies. We encourage you to review those terms before connecting any third-party services to your Creww account.

11. TERMINATION

We may suspend or terminate your access to the Services at any time, with or without cause or notice, including if we believe you have violated these Terms.

You may terminate your account at any time by contacting us or using the account deletion feature in the app. Upon termination:

Your right to use the Services will immediately cease
We may delete your account data in accordance with our Privacy Policy
Provisions of these Terms that should survive termination will remain in effect

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREWW AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use or inability to use the Services
Any injuries or health issues arising from physical activities
Inaccurate fitness data or recommendations
Unauthorized access to your account or data
Any third-party conduct or content

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Creww and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

Your use of the Services
Your violation of these Terms
Your User Content
Your violation of any rights of another party

14. DISPUTE RESOLUTION

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.

Informal Resolution: Before filing any claim, you agree to try to resolve the dispute informally by contacting us at saif@creww.health. We will attempt to resolve the dispute through good-faith negotiations.

Arbitration: Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware, and the arbitrator's decision shall be final and binding.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

15. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the "Last updated" date. We may also notify you through the app or via email.

Your continued use of the Services after any changes indicates your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Services.
